📨AGREEMENT
By agreeing to these terms of service, The Client agrees to the following:
- Clients MUST be 18 years or older.
- Clients DO NOT have the right to mint/sell their commissions as NFT nor use the art for generative AI purposes. Doing so is in violation of these terms.
- Clients may not copy or trace my work in any way, unless expressly given permission.
- Clients may edit their commission works in minor ways, such as in Profile Pictures, Social Media Banners, or YouTube Thumbnails and similar cases,
- Clients will credit Waisajhbee for the work when reposting commissioned work.
- Clients may produce physical reproduction of their work for PERSONAL USE ONLY (NOT for sale.)
- My commissions are for PERSONAL USE ONLY unless otherwise discussed. Up to the extent that these terms outline, you will not profit off of my work unless coming to a written agreement with me beforehand.
- I retain the copyright to all work I produce. This includes use of the self-promotion, as example work in sales of commissions, the right to distribute, and the right to reproduce the work, unless an agreement is made stating otherwise. For commissions that are public (no limitations stating on posting the work) I may post these works to my other social media platforms with proper credit to the client for ownership of the character's design.
- The Client agrees to provide Waisajhbee with the following necessary information:
~ Color Palettes, and Reference-Sheets (or an Equivalent) are REQUIRED
~ Payment email required for receiving invoice.
~ Social Media handles for proper crediting of commissioned work.
~ Preferred name and pronouns in the case of lengthy communication.

📨PROJECT
- Waisajhbee reserves the right to refuse any project.
- Waisajhbee reserves the right to cancel any ongoing project if necessary. (See REFUNDS AND DELIVERY for more information.)
- Projects are only officially accepted once an invoice has been issued and the full amount has been paid OR the 1st payment of the agreed upon payment plan is paid.
- The Client must provide necessary information, such as character references, pose, or composition references, and any other information they deem needed in order for Waisajhbee to begin work. Failing to provide necessary information may cause delay on the delivery of the commission.
📨PROJECT
- I will not begin work on a commission until full payment is received OR 1st payment of agreed upon payment plan is received.
- Payments will be sent through Invoices ONLY.
- Prices listed are baseline and can fluctuate above the list price based complexity.
- Additional fees may apply depending on what the work is intended to be used for. (Please see section USAGE AND NDA for more information.)

📨PROCESS
- Expected a turnaround time of 2 Months [IF List is FULL], depending on the scope of the project. Individual Illustrations may take 1-2 Weeks, depending on the complexity. The range of this can vary based on my own personal schedule, and the length of the queue, so please plan accordingly. Generally a sketch will be provided within the first month, after the initial payment is received.
- After closing form submissions, I will reach out to those I've selected for that batch, via the mode of contact listed on the form.
- I will NOT reach out to those whos work I am not taking on, but I will announce on my social medias when all chosen projects have been contacted.
- If I receive no confirmation of the commission proposal within two weeks of being sent, the commission will automatically be cancelled.
- For all commission types, you will receive a sketch for initial approval. If you must request changes I ask you do it at this phase.
- Changes requested after starting line art may incur additional fees.
- In cases where there are small things I have missed, I will change them no additional charge. (Ex. I forgot a character's necklace, or used the incorrect eye color.)
- For smaller projects, I usually send less work-in-progress shots unless requested, so please feel free to ask!
- Completed commissions will be sent in their full resolution via Google Drive Link, unless otherwise specified. In the case of payment plans: Completed Commission files will only be sent after the final payment on the invoice is fulfilled.
📨REFUNDS AND DELIVERY
- Full refunds may occur if a commission has been cancelled BEFORE Waisajhbee has started working on it.
- If the commission process has already started, a partial refund may be available depending on to what extent the project is completed.
- Partial refunds may be available if Waisajhbee has failed to deliver a commission in a reasonable, timely manner. (Exceeding 2 months with no communication.) Some leniency is allowed as delays in expected project timeline are clearly communicated with the Client.
- Delivery of a project (project files) may be withheld if payment from the Client is not fulfilled at the time Waisajhbee has completed the work.
📨USAGE AND NDA
- All commissions are for PERSONAL USE ONLY.
- Commercial usage will have to be discussed!
- The Client may request additional usage rights for the commissioned work during the ordering process. I consider the following use cases of commercial use:
Reproduction of the work, publicly or privately, in which you will receive profit from my work.
- The fee incurred by commercial usage rights is broken into the following tiers:
- 1) +10% - YouTube, Twitch, Social Media Promotional Material (Use in Digital Monetized Content. - i.e. Overlays, Thumbnails, and other directly monetized content.)
-2) +25% - Reproduction, Selling, Merch (Use in Merchandise for Sale i.e. Art Prints, Apparel Designs, Charms or Keychain Designs.)
**This fee is subject to increase at the scope of the project, such as applying to groups, businesses, and corporations.
- A Client may request for their project to remain private during the ordering process. This means Waisajhbee will not be able to stream work of, post WIPS of, or post completed versions of the project until an agreed upon date in the future.
📨FAQ
How to get on the WAITLIST for Commissions:
When filling out a request form, there is an option to "allow yourself to be moved to waitlist." I will then choose about 2~4 orders to move to the waitlist. Doing this allows me to choose the projects that I feel confident in working on, without becoming overwhelmed by the amount of requests could be coming in.
